1. Who we are and who these terms are for
Social-238 is a service operated by the operator of the radar, an individual established in Argentina ("we", "us"). It finds public creators on TikTok and Instagram, reads their public profiles without logging in or through Instagram's official interface for business accounts, stops reading when a platform blocks it, and keeps one list of them. We sell access to that list to businesses.
These terms are a contract between us and the business that signs up ("you", "the customer"). By creating an account, using the service or paying an invoice, you accept them.
- Social-238 is for businesses only: brands, agencies, app and product teams. It is not for consumers or personal use.
- The person who accepts these terms confirms they may bind the business.
- Our privacy notice explains how we handle creator data. Customers in the EU, the UK or Brazil also sign our data sharing agreement, which forms part of these terms.
2. What the list holds
For each creator the list may hold: handle, display name, follower counts, bio text, links, posting dates, the history of counts by day, contact details the creator published in the profile, a place inferred from public signals, an apparent-age band estimated from video, engagement scores, and a yes or no judgment on whether the account is one real person.
- We never store a face template or any other biometric code.
- The age band is a broad range, not a birth date and not a verified age.
- We do not collect special-category data on purpose (health, religion, politics, sexual life, ethnic origin). If any appears in a bio, it is not used as a filter or a score.
- Accounts that may belong to people under 16 are kept out of what we sell.
3. Account, organisation and seats
- Each customer has one organisation. An organisation has the number of seats its plan allows.
- A seat is one named person. Seats are not shared.
- You keep sign-in details safe and tell us at once if you think someone else has used them.
- You are responsible for what happens under your organisation, including the acts of your staff and contractors.
4. Plans, quotas and payment
- Plan names, limits and prices are on our plans page.
- The Free plan is permanent, not a trial. It gives sign-in, counts and the map, and 20 full profiles a month. It has no export and no API.
- Visitors who are not signed in see counts, the map and a 10-row sample without handles.
- No plan, paid or free, gives bulk access to the whole data. Every plan is metered by monthly quotas: profiles viewed, rows exported and API calls.
- Each paid plan sets a number of seats and those monthly quotas.
- When a quota or cap is reached, the service stops that use until the next month or a plan change. We do not bill overage without your written agreement.
- For now we bill paid plans by hand: we send an invoice, and you pay it by the method it names. There is no automatic billing.
- Invoices are due within 15 days. Prices are shown without taxes; any taxes due are yours.
- We may change prices with at least 30 days notice by email. The new price applies from your next billing period. If you do not agree, you can cancel before it applies.
- Fees already paid are not refunded, except where the law requires it or these terms say so.
5. Acceptable use
You use Social-238 to find and work with creators for business purposes. You must not:
- harass, stalk, threaten, dox or track any creator, online or offline, or try to find a creator's home or private contact details;
- build profiles about health, religion, politics, sexual life, ethnic origin or other sensitive traits, or infer them from the data;
- contact or target anyone who is or may be under 18 for marketing, and never anyone who may be under 16;
- use the data to make decisions about employment, housing, credit, insurance, education, immigration or law enforcement, or for any unlawful discrimination;
- combine the data with other sources to identify people who are not public creators;
- break the law of any place where you operate, including data protection and marketing laws;
- try to get around any block, rate limit or protection of TikTok, Instagram or Social-238, scrape Social-238, or probe or attack its systems.
When you contact a creator, you do so in your own name and you follow the platform's rules and the law that applies to that message.
6. Your licence to the data
- We grant you a non-exclusive, non-transferable licence to use the data you get from Social-238 inside your own business, while your plan is active.
- You must not resell, sublicense, rent, publish or give the raw data to anyone else, and you must not bulk re-export it into another database, product or service offered to third parties.
- Your access is limited to your plan's monthly quotas. You must not try to get the whole data, for example by splitting use across accounts, keys or organisations, or by adding up exports and API calls over time to rebuild the list.
- Agencies may use the data to serve their own clients, for example by sharing a shortlist of creators for a campaign, but may not hand a client the list itself or access to it.
- You may create derived works (shortlists, reports, campaign plans, your own scores) and keep them. Attribution to Social-238 is not required.
- We keep all rights in the service, the list as a whole and our methods.
7. Removals pass through to you
Creators can ask to be removed through our removal page. A removed creator stops appearing in the page, the exports and the API.
- You must delete a removed creator from every copy you hold, including exports and caches, within 30 days of the removal.
- The API shows each creator's suppression state, so you can check your copies. You should check at least once a month.
- Derived works may keep a removed creator only where you have your own lawful reason, such as an existing contract with that creator.
- If a creator asks you directly to stop using their data, tell us at removals@social238.com so we can remove them too.
8. API terms
- Each organisation gets one API key. Keep it secret, never put it in a public page, app or repository, and tell us at once if it leaks. We may revoke a key that is exposed or abused.
- The API is available on paid plans only. It has rate limits and a monthly quota set by your plan. Calls over a limit are refused, not billed.
- The API is versioned in its path (for example
/v1/). We will give at least 90 days notice before we remove or break a version. - We log each call (key, operation, count, time). We do not log the answers.
9. Service levels
- We run Social-238 on a best-effort basis. There is no uptime commitment and no service level agreement for now.
- We publish a status page and announce planned work there when we can.
- Platforms may block or change their pages at any time. Coverage and freshness may change as a result.
10. Suspension and termination
You may cancel at any time; your plan runs to the end of the period already paid.
We may suspend or end your access, with notice where we can, if:
- you breach these terms, in particular sections 5, 6 or 7;
- an invoice is unpaid 15 days after its due date;
- your use harms creators, the platforms, other customers or the service;
- a court, regulator or platform demand requires it.
When access ends, you have 14 days to export the data your plan allows (within its quota), unless the end is for abuse or a legal demand. After that, your access stops. Sections 6, 7, 11, 12, 13 and 14 survive the end of these terms; you must still honour removals for any copies you keep.
11. No warranties
- The data comes from public sources and from our own estimates. It may be wrong, incomplete or out of date.
- The place is inferred, not confirmed. The age band is an estimate from video, not a verified age. The "one real person" result is a judgment, not a fact.
- The service is provided "as is" and "as available". To the extent the law allows, we give no warranty of accuracy, fitness for a purpose or non-infringement.
- You check a creator yourself before you rely on the data for anything important.
12. Limits on liability
- Our total liability under these terms is limited to the fees you paid us in the 12 months before the claim.
- Neither side is liable for indirect or consequential damages, such as lost profits, lost revenue or lost business.
- These limits do not apply to wilful misconduct or fraud, to your breach of sections 5 or 6, to your payment duties, or where the law does not allow them.
13. Your indemnity
You will defend and hold us harmless against claims, fines and costs from third parties (including creators, platforms and regulators) that arise from your use of the data, your contact with creators, or your breach of these terms or the law.
14. Confidentiality
- Each side keeps the other's non-public information confidential and uses it only for this contract. This covers your searches and lists, and our methods, prices and non-public documents.
- This does not cover information that is public, already known, independently developed, or that the law or a court requires to be disclosed.
15. Changes to these terms
We may change these terms. We will email you at least 30 days before a change takes effect. If you keep using Social-238 after that date, the new terms apply. If you do not agree, you can cancel before then. A change required by law may apply sooner.
16. Governing law and courts
These terms are governed by the laws of the Republic of Argentina. Disputes go to the ordinary commercial courts of the Republic of Argentina. This may change when the entity that operates Social-238 changes; we will tell you under section 15 if it does.
17. General
- You may not transfer this contract without our written consent. We may transfer it to a successor entity that operates Social-238.
- If a part of these terms is invalid, the rest stays in force.
- These terms, the plan you chose and, where signed, the data sharing agreement are the whole agreement between us.
